طالب قانونيون وسياسيون بفتح ملف التعذيب والانتهاكات الأمنية في عهد النظام السابق، والتي أدت إلى سقوط أكثر من 300 قتيل تحت وطأة التعذيب، ومحاسبة المتورطين في ارتكاب تلك الجرائم، وتوقيع العقوبة الرادعة على الضالعين في عمليات التعذيب التي كان وزير الداخلية السابق حبيب العادلي يبررها بأنها لا تعكس منهجا لوزارته، ودأب على اعتبارها ناجمة عن ممارسات فردية، على حد قوله.
وصرح المحامي مختار نوح، وهو واحد من المتبنين لهذا الملف لـ "المصريون"، أنه سيتم مناقشة فتح ملف التعذيب والانتهاكات الأمنية في حق الشعب المصري في اجتماع "البرلمان الشعبي" اليوم، ودراسة تقديم الرئيس السابق حسني مبارك ووزير الداخلية السابق حبيب العادلي للمحاكمة، لتحملهما المسئولية عن ذلك، وسيتم تشكيل لجنة تحقيق، وتقصي حقائق حول قضايا القتل تعذيبا والقتل في العهد السابق، إلي جانب بحث أسباب التباطؤ من جانب المجلس العسكري في فتح تلك الملفات.
واعتبر نوح أنه كان أجدر بالمجلس العسكري بدلاً من أن يحاكم العادلي أولاً عن قتل المتظاهرين- التي رأى أنها كانت آخر "جريمة ارتكبها- أن يقوم بمحاسبته ومحاكمته عن الانتهاكات من جانب وزارته ضد المواطنين في الجرائم السابقة على ذلك.
وكشف أن هناك أكثر من 322 مواطنا قتلوا تحت التعذيب، من بينهم عبد الحارث مدني عام 1995، ومحمد عبد القادر في عام 2006، وقتيلا الإسكندرية خالد سعيد والسيد بلال سنة 2010، مشيرا إلى أن كل تلك الجرائم ثابتة بالأدلة.
من جانبه، رأى المفكر جمال أسعد عضو مجلس الشعب السابق أن عدم فتح ملفات التجاوزات الأمنية حتى الآن يرجع إلى أن الثورة لم تضع أقدامها على أرض الواقع السياسي حتى تلك اللحظة، وأنها الآن لا تزال روحًا هائمة لم تتقمص جسد الوضع السياسي على أرض الواقع.
وقال إن الثورة لا تزال مبادئ وشعارات، النظام القديم لا يزال قائما، حيث أن رأس النظام – في إشارة إلى الرئيس السابق حسني مبارك- هو الذي اسقط فقط، لكن النظام بكافة مؤسساته وأشخاصه لا يزال قائما، معتبرا أنه من غير الطبيعي أو العادي أن تكون هناك ثورة ويسقط رأس النظام ويظل الأشخاص والمؤسسات حتى بعد سقوطه، معتبرا أن هذا تناقض لا يجوز.
وأكد: أننا لا نتحدث عن هذا الملف فقط، بل هناك عشرات بل مئات الملفات التي يجب أن تفتح حتى نشعر أن هناك ثورة حقيقية، مشيرا إلى أن ملف التعذيب هو أحد أهم الملفات الشائكة التي يجب أن تبدأ بها الثورة ويبدأ بها المجلس الأعلى للقوات المسلحة، باعتبار أنها "تهم" لا تسقط بالتقادم، فكما بدأ بمحاسبة الفاسدين وتحويلهم للنيابة العامة والمحكمة الجنائية يجب أن يتوازي مع هذا محاكمة الذين قاموا بتعذيب المصريين خلال العهد السابق.
وطالب أسعد بفتح هذا الملف على وجه السرعة، خاصة أن جهاز الشرطة هو الذي قام بـ "مؤامرة لتخريب الثورة والوطن وحتى هذه اللحظة لم يتضح معالمها بعد، فعندما تنسحب الشرطة في لحظة حاسمة وخطيرة وكأن الأرض انشقت وبلعتهم، وعندما يتوازى مع ذلك تخريب وحرق وتدمير وفتح للسجون من الشرطة ذاتها، فهذه مؤامرة، ولابد أن نعرف تفسيرها وتفصيلها ومن ورائها، وتقديمه للمحاكمة".
وأعتبر أن التصور العام لدي المجلس الأعلى للقوات المسلحة هو أنه يمسك بزمام الأمور لمدة مؤقتة ويريد أن يسلم الحكم والملفات إلى النظام السياسي القادم، مشيرا إلى أن هناك عبئا ثقيلا على القوات المسلحة لا يمكن إنكاره .
واقترح تشكيل مجلس رئاسي من مدنيين وعسكريين يرأسه عسكري يقوم بإدارة شئون البلاد ليرفع العبء عن القوات المسلحة ويبدأ فتح هذه الملفات، مؤكدا أهمية إيجاد مسارات في المرحلة الانتقالية تؤكد قيام الثورة وتفعيل مبادئها.
بدوره، لاحظ القيادي الإخواني الدكتور جمال حشمت أن هناك اهتماما بالمال المسلوب دون أن يهتم أحد بالكرامة والأعراض المنتهكة والشهداء والإصابات والتعذيب والقتل، على الرغم من أن الثورة بدأت لطلب ونيل الحرية وليس لطلب المال، حيث رأى أن التحقيقات كلها تسير في اتجاه آخر مخالف لمطالب الثورة.

واتهم حشمت حكومة تسيير الأعمال برئاسة الفريق شفيق بأنها "ما جاءت إلا لتسهل التهريب وتسهل حرق مستندات الإدانة"، واصفًا النظام القائم حتى الآن بـ "المتآمر"، وأن "القائمين عليه لا أحد منهم يؤتمن علي هذه الثورة"،، وطالب بإقالة تلك الحكومة على الفور.
وطالب المجلس العسكري أن يسارع في محاكمة المتهمين بالقتل والتعذيب والترويع قبل محاكمتهم علي اختلاس الأموال، وقبل أن "تباد باقي مستندات الإدانة، فكل تلك المستندات تحرق الآن، وهذا يضع المسئولية في رقبة المجلس الأعلى الذي تولي السلطة منفردا دون مجلس رئاسي معه، ويتحملها أحمد شفيق وحكومته التي سهلت المأمورية"، على حد تعبيره.
